Terms of Service

By accessing or using Rospeak ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

Durch den Zugriff auf oder die Nutzung von Rospeak ("die Plattform") erklären Sie sich mit diesen Nutzungsbedingungen ("Bedingungen") einverstanden. Wenn Sie mit diesen Bedingungen nicht einverstanden sind, nutzen Sie die Plattform nicht.

Rospeak is a decentralized content platform built on blockchain technology. The Platform enables users to:

• Publish content to the blockchain
• Monetize content directly from their audience
• Own and control their content
• Interact with other users through encrypted messaging

3.1 Wallet Connection: To use the Platform, you must connect a compatible Web3 wallet (MetaMask, WalletConnect, Coinbase Wallet, etc.). You are responsible for maintaining the security of your wallet and private keys.

3.2 Account Security: You are solely responsible for all activities that occur under your wallet address. Never share your private keys or seed phrases with anyone.

3.3 Age Requirement: You must be at least 18 years old to use the Platform.

4.1 Your Content: You retain all rights to content you publish on the Platform. By publishing content, you grant Rospeak a non-exclusive license to display and distribute your content.

4.2 Prohibited Content: You may not publish content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains malware or harmful code
• Promotes illegal activities
• Contains child exploitation material
• Impersonates others or misrepresents your identity

4.3 Content Moderation: While Rospeak is censorship-resistant, we reserve the right to remove content from our frontend interface that violates these Terms or applicable laws.

6.1 Platform Fee: Rospeak charges a 5% platform fee on content sales. Creators receive 95% of revenue.

6.2 Gas Fees: Users are responsible for all blockchain transaction fees (gas fees) required to interact with smart contracts.

6.3 Withdrawals: Creators can withdraw earnings at any time, subject to blockchain transaction fees.

6.4 No Refunds: Due to the nature of blockchain transactions, payments are generally non-refundable.

7.1 Your IP: You retain all intellectual property rights to your content.

7.2 Platform IP: The Rospeak platform, including its design, code, and branding, is owned by Rospeak GmbH and protected by copyright and trademark laws.

7.3 DMCA: We respond to valid DMCA takedown notices. Contact legal@rospeak.com for copyright concerns.

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee that the Platform will be:

• Error-free or uninterrupted
• Secure or free from viruses
• Compatible with all devices or browsers
• Available at all times

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROSPEAK SHALL NOT BE LIABLE FOR:

• Loss of profits, data, or business opportunities
• Indirect, incidental, or consequential damages
• Damages resulting from blockchain network failures
• Loss of cryptocurrency or digital assets
• Unauthorized access to your wallet
• Content published by other users

You agree to indemnify and hold harmless Rospeak, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Platform
• Your content
• Your violation of these Terms
• Your violation of any laws or third-party rights

11.1 By You: You may stop using the Platform at any time by disconnecting your wallet.

11.2 By Us: We may suspend or terminate your access to the Platform if you violate these Terms.

11.3 Effect: Termination does not affect content already published to the blockchain, which remains permanent.

These Terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of [City], Germany.

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the new Terms.
